TOWN OF CANAAN RESOLUTIONS: 2007
RESOLUTION #1: Official Newspaper Designation Be it resolved that the "Independent", a newspaper, having a general circulation in the Town of Canaan be and is hereby designated and appointed as the official newspaper for the Town for the year 2007. Be it further resolved the public notices regarding meeting changes, and/or needed vacancies shall also appear in the “Register Star” to insure timely notification to the public. RESOLUTION #2: Official Bank(s) Designation Be it resolved that the Bank Of America is hereby designated as the official depositories for all funds of the Town of Canaan for the fiscal year 2007. RESOLUTION #3: Mileage/Travel Allowances Be it resolved that forty-four and a half (44.5) cents per mile be paid, after audit of properly submitted claims for the use of privately owned vehicles on official Town business, provided that funds for such expenses are available in the current budget; and be it further resolved, THAT THE ASSESSOR, ANIMAL/DOG CONTROL OFFICER, ZONING ENFORCEMENT OFFICER AND THE BUILDING INSPECTOR; SHALL BE PAID MILEAGE FOR NORMAL OFFICAL BUSINESS TRAVEL WITHIN THE TOWN OF CANAAN; however, no one will be paid mileage for travel to and from his/her Town office or for attending "in" Town Board or Committee meetings. Also no mileage may be duplicated through any other source;(i.e.: County or State government). Only one (1) person from a Department will be reimbursement when others attend the same training. RESOLUTION #4: Town Board Meeting Dates Be it resolved that the Town Board shall meet on the second Monday of each month at the Canaan Town Hall at 7:00 PM for the regular monthly meeting, except in the month of November which meeting shall be held on the Thursday immediately after election; and except that any scheduled meeting may be canceled or the date and/or time changed at any time by a majority vote of the members of the Town Board. RESOLUTION #5: Sec. 30 Fiscal Report Be it resolved that pursuant to Sec. 29 subd. 10A of the Town Law the Supervisor is directed to submit to the Town Clerk within sixty days after the close of the fiscal year, a copy of the report to the State Comptroller which is required by Sec. 30 of the General Municipal Law, and the Town Clerk shall cause a summary of such report to be published in a form approved by the State Comptroller in the official Town newspaper within 10 days after the receipt thereof; be it further resolved that this shall be in lieu of preparation of the report required by Sec. 29 of the Town Law. RESOLUTION #6: Investment of Idle Funds Be it resolved that the Supervisor be and is hereby authorized to invest idle funds of the Town of Canaan in Certificates of Deposit or U.S. Treasury Bills from time to time as it becomes apparent that such funds will not be required to meet the immediate commitments of the Town. RESOLUTION #7: Purchasing Practices Be it resolved that for the fiscal year 2007 the Town Board of the Town of Canaan establishes the following purchasing practices: 1. No purchase may be made outside of New York State over $500.00 without prior approval of the Town Board of the Town of Canaan. 2. The Town Supervisor may make purchases not to exceed $1,000.00 without Town Board approval and per Resolution #42 of the year 1996, the Highway Department may make no purchase over $5,000.00 without prior approval of the Town Board of the Town of Canaan, per Resolution #7 of the year 2002. No committee may expend any funds without prior approval from the Budget Officer (under $1,000.00) or the Town Board’s approval (over $1,000.00) with the exception of expendables. RESOLUTION #8: Appointment Animal/Dog Control Officer Be it resolved that Eric Lagerwall be and is hereby appointed Animal/Dog Control Officer of the Town of Canaan, to serve at the pleasure of the Town Board, at an annual salary of $2,741.00, to be paid as specified in Resolution #28, plus such other civil fees, mileage, poundage, etc., as he may earn in the performance of civil duties as Animal/Dog Control Officer. RESOLUTION #09: Appointment Town Hall Caretakers Be it resolved that Randy and Jeanine Moshimer be and are hereby appointed as Caretaker of the Town Meeting Hall at an annual salary of $3,605.00, to be paid as specified in Resolution #28 and the said duties be described by the Building Committee. RESOLUTION #10:Appointment Zoning Enforcement Officer Be it resolved that Harold Patrick Pulver be and is hereby appointed as Enforcement Officer to serve at the pleasure of the Town Board at an annual salary of $12,330.00 to be paid as specified in Resolution #28. Be is resolved that the appointed Building Inspector will serve at the pleasure of the Town Board at an hourly wage as specified in Resolution #28. RESOLUTION #11:Appointment Town Historian Be it resolved that Anna Mary Dunton previously appointed as Town Historian is confirmed by this position, such confirmation to be noted in the Town Record. RESOLUTION #12:Appointment General Counsel Be it resolved that Lois Phillips, Esq. shall be employed as Attorney to the Town of Canaan for all general matters requiring legal advice or action during 2007; and be it further resolved that payment for such counsel shall be as outlined in contract approved by the Town Board and be it further resolved that for litigation, municipal finance and labor issues Hiscock & Barclay is hereby appointed to handle these services on a case by case basis, at an hourly rate. RESOLUTION #13:Appointment Accountant/Budget Officer Be it resolved that Nelson Furlano be and is hereby appointed as Town Accountant at an annual payment of $8,400.00 to be paid as specified in Resolution #28; and be it further resolved that Gary Flaherty be and is hereby appointed as Town Budget Officer for the Town of Canaan. RESOLUTION #14:Appointment Chairman Town Planning Board Be it resolved that Don Malin be and is hereby designated as Chairman of the Town Planning Board. Be it further resolved that the Planning Board appoint Ron Davis as Deputy Chairperson. (approved January 8,2007) RESOLUTION #15:Appointment Chairman Zoning Board of Appeals Be it resolved that the Town Zoning Board of Appeals appoint a Chairperson and a Deputy Chairperson by 02/28/2007. RESOLUTION #16:Appointment Records Management and Freedom of Information Officer Be it resolved that Charlotte Cowan be and is hereby appointed as Records Management and Freedom of Information Officer for the Town of Canaan, with the Supervisor acting as the appeals agent, and will call on the Ethics Committee should there be a conflict for the Supervisor. RESOLUTION #17:Appointment Registrar of Vital Statistics Be it resolved that Charlotte Cowan be and is hereby appointed as Registrar of Vital Statistics for the Town of Canaan at an annual salary of $274.00 to be paid as specified in Resolution #28.
RESOLUTION #18:Appointment of Clerks Be it resolved that Ann Davis be and is hereby appointed as Court Clerk for the Justice Court of the Town of Canaan at a rate of pay as specified in Resolution #28. Be it further resolved that Daryl Schiffer be and is hereby appointed as Highway Clerk, Barbara Fischer be and is hereby appointed as Deputy Town Clerk, and Courtney Cowan, second deputy Town Clerk all to be paid at the rate of pay as specified in Resolution #28. RESOLUTION #19:Appointment of Clerks to Planning & ZBA Be is resolved that Tammy Flaherty be and is hereby appointed as Clerk to the Planning Board of the Town of Canaan at a rate of pay as specified in Resolution #28; and that Julie Alexander be and is hereby appointed as Clerk to the Zoning Board of Appeals of the Town of Canaan at a rate of pay as specified in Resolution #28. RESOLUTION #20: APPOINTMENT of ASSESSOR Be it resolved that Jon Craig Surprise is duly designated Assessor for the year 2007 at an annual salary of $19,398.00 to be paid as specified in Resolution #28, and be it further resolved that his re-appointed (as stated in resolution #8 of 2001) is October 1, 2001 to September 30, 2007.
RESOLUTION #21:Appointment Recreation Committee Be it resolved that the following named residents of the Town of Canaan shall comprise the Recreation Committee for the Town of Canaan for the year 2007 with the express purpose of operating the summer recreation program within the confines of the 2007 Town of Canaan budget: Martha Paolucci, Darsi Fredrick, Barbara Patzwahl, Natalie Hanson, Curt Morris, and Primo and Connie Medica. *RESOLUTION #22:Appointment of Committees Whereas the Supervisor may appoint committees of Town Board members to make studies and report back with recommendations, be it resolved that the Town Board concurs with the Supervisor’s following assignments for the fiscal year 2007. TO BE APPOINTED AT THE FEBRUARY TOWN BOARD MEETING. Buildings: Finance Committee: These committees will operate under established “Functions and Duties”. The Town Clerk shall notify all appointees to take the appropriate oath of office. RESOLUTION #23: Appointment Board of Ethics Be it resolved that the following named residents of the Town of Canaan shall comprise the Board of Ethics for the Town of Canaan for the year 2007: Al Vinck (chairperson), Paul Naamon, John Kowalski, Joe Davis, and Jack Leal. RESOLUTION #24:Appointment Deputy Highway Supt Be it resolved that the Deputy Highway Superintendent for 2007 shall be William Durlack
RESOLUTION #25:Required Reports Be it resolved that the Zoning Enforcement Officer, Dog Control Officer, Tax Collector, Registrar of Vital Statistics and Highway Superintendent shall submit to the Supervisor prior to each monthly meeting of the Town Board, in the form specified by the Town Board, including revenues derived therefrom and/or expenditures incurred, a report of all business transacted or all activities completed during the previous month, copies of which will be filed with the Town Clerk; and be it further resolved that the Town Clerk shall notify in writing each person involved by January 30, 2007 as to the nature of the required reports. Revenues must be turned in to the Town Clerk as collected. All Clerks time sheets must be submitted to the Town Clerk, signed by the department Chairperson/Supervisor of each individual department, before they are submitted for payment.
RESOLUTION #26: Required In-Service Training/Education Be it resolved that all elected and appointed Town of Canaan officials are to successfully complete within a reasonable time frame the necessary in-service training programs to ensure proper compliance with the duties/responsibilities of the office to which each is elected/appointed. Included in this requirement are all in-service programs required by County, State or Federal mandates and any other in-service programs deemed appropriate by the Town Board of the Town of Canaan. Any costs associated with these in-service training programs will be the responsibility of the Town of Canaan. RESOLUTION #27: Pay Scale/Benefits Highway Department: Be it resolved that the scale of wage rates and benefits for the Highway Department employees and other full time Town employees, for the year 2007 shall be as follows: Effective January 1, 2007 WAGES: Street Maintenance Foreperson $17.60 per hour/one employee Senior Motor Equipment Operator $17.08 per hour/one employee Motor Equipment Operator II $15.78 per hour/two employees Motor Equipment Operator I $14.48 per hour/one employees (Part-Time) As needed* Laborer Part-time $12.21 per hour/two employees (Probationary) $11.00 per hour/none Flag Person(s) $ 9.53 per hour/two as needed Clerk 20 hours per week $10.96 per hour/one employee [Probationary: A period of 1 year from date of hire.] [* Currently authorized by Town Board.] STANDARD WORK DAY: The hourly paid employees of the Town of Canaan Highway Department shall work a standard workday commencing at 8:00 AM and ending at 4:30 PM with 1/2 hour for lunch. STANDARD SUMMER WORKDAY: The hourly paid employees of the Town of Canaan Highway Department shall work a standard summer workday of ten hours (10), four (4) days a week as determined by the Highway Superintendent/Town Board.
RESOLUTION #28 -HIGHWAY AND FULL TIME EMPLOYEES BENEFITS: (full time employees work 21 hours or more per week) VACATION – Completion of 1 year 5 days Completion of 2 to 5 years 12 days Completion of 6 to 10 years 15 days Completion of 11 to 15 years 19 days Completion of 16 to 20 years 22 days
PAID HOLIDAYS: New Years Day January 1, 2007 Martin Luther King Day January 15, 2007 Presidents Day February 19, 2007 Good Friday April 06, 2007 Memorial Day May 28, 2007 Independence Day July 4, 2007 Labor Day September 3, 2007 Columbus Day October 8, 2007 Election Day November 6, 2007 Veteran's Day November 12 2007 Thanksgiving Day November 22, 2007 Day after Thanksgiving November 23, 2007 Christmas Day December 25, 2007 BIWEEKLY PAY PERIODS: The last pay period for fiscal 2007 will end December 31, 2007, at 12:00 midnight with each succeeding pay period ending every other Friday thereafter. The Highway Superintendent shall submit the payroll to the Supervisor within three (3) days of the close of the pay period and the Supervisor shall prepare the payroll and issue paychecks within seven (7) days of the close of the pay period. Payday will be on Friday unless it falls on a holiday, with the exception of Highway Summer hours. SICK DAYS: Five (5) per year with two (2) days convertible to personal days with the prior approval of the Highway Superintendent/Supervisor. Unused sick days may be accumulated to a total of forty-five (45) days. PERSONAL DAYS: Three (3) per year with no accumulation rights. HOSPITALIZATION: Fully paid by the Town to include dental and paid prescription plan, offered to present employees that work a minimum of twenty-one hours (21) or more each week. PENSION PLAN: New York State Retirement Plan offered to all employees. BEREAVEMENT LEAVE: Three (3) days for immediate family: father, mother, sister, brother, child or spouse. CREDIT UNION: All Town employees will have available to them employee participation through payroll deductions in the Columbia Greene Federal Credit Union, 207A Green St., Box 1339, Hudson, NY 12534. RESOLUTION #28: Pay Rates/Periods General Fund Be it resolved that the following pay rates and pay periods shall cover the following General Fund employees and elected officials: Supervisor $ 6,300.00 per year payable monthly Town Clerk $24,110.00 per year payable biweekly Deputy Town Clerk $ 10.96 per hour payable biweekly* Deputy Town Clerk II $ 1,643.87 per year payable quarterly Accountant $ 8,400.00 per year payable monthly Highway Clerk $ 10.96 per hour payable biweekly* Justices (each) $ 9,066.00 per year payable monthly Court Clerk $ 10.96 per hour payable biweekly* Planning Board/ZBA Clerks (Each) $ 9.87 per hour payable quarterly* Supt. of Highways $42,560.00 per year payable biweekly Council Members (Each) $ 1,800.00 per year payable quarterly Tax Collector $ 4,384.00 per year payable biweekly Assessor $19,398.00 per year payable monthly Assessor's Clerk $10,330.00 per year payable biweekly* Dog Control Officer $ 2,741.00 per year payable quarterly Caretaker Town Hall $ 3,605.00 per year payable quarterly Building Inspector $12,330.00 per hour payable biweekly Reg. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Virginia Nightingale-yes; Councilperson Stephen August-yes; Councilperson Carrie Bither-yes; and Councilperson David Patzwahl-yes. Motion Carried. *All appointed hourly employees will be compensated for the time actually worked. Resolution #29: Payment of Monthly and Elected Officials: All monthly and quarterly employees and elected officials will be paid on the last Friday of the month in which payment is due. All other employees payrolls will be submitted to the Supervisor for review and submission for payment. Payday will be on Friday for all employees and elected officials. Resolution #30: Delegating on behalf of the Board: Pursuant to Town Law, S.29(16), be it resolved that the Town Board hereby authorizes and delegates to the Town Supervisor powers and duties of day-to-day administration and supervision of all town and special district facilities and employees consistent with and in furtherance of any and all State and Federal laws applicable thereto and with any and all local laws, resolutions or policies heretofore or hereafter adopted by this Town Board. RESOLUTION #31: Intermunicipal Agreement w/Town of Austerlitz, Chatham, New Lebanon, and Ghent: Be it resolved that an agreement with the Town of Austerlitz for snow removal and ice control of certain Town of Canaan roads more readily accessible to the Town of Austerlitz, at an annual contract fee of $300.00 shall be continued for the year 2007 subject to the approval of the Highway Superintendents of the Towns of Austerlitz and Canaan and the Town Boards of the Towns of Austerlitz and Canaan. Other inter-municipal work shall be recorded for the received services to insure an equal share of remuneration to each town. RESOLUTION #32: Be it resolved that Joe Davis is hereby appointed to the Town of Canaan Planning Board for a seven-year term (January 01, 2007-December 31, 2013). Be it further resolved that David Cooper is hereby appointed to the Town of Canaan Zoning Board of Appeals for a five-year term (January 01, 2007-December 31, 2011).
