Minutes of meeting held August 27, 2007

SPECIAL TOWN BOARD MEETING – AUGUST 27TH, 2007

Supervisor Gary Flaherty read the Public Notice: Please take notice that the Canaan Town Board will hold a special meeting on August 27th, 2007, at the Canaan Town Hall, 1647 County Route 5, at 7:00 p.m. The purpose of the meeting is to interview the Assessor applicants for said position, and the vacated justice position, followed by discussions and decisions.

There were four board members present:
Supervisor Gary Flaherty present
Councilperson Virginia Nightingale present
Councilperson Carrie Bither present
Councilperson David Patzwahl present
Councilperson Stephen August absent
There were fourteen people in the audience.

Applicants for the Assessor position were Jean R. Rohde who is unable to attend this evening but will be interviewed at the September 10th, 2007 meeting. Mr. Garth J. Slocum is present for this evening’s interview.

Supervisor Gary Flaherty spoke of the proposed interim increase in the Justice salary. Supervisor Flaherty read the Town attorney’s decision: If a Town Justice is not a member of the Town Board, the Board may increase the salary of the Town Justice by resolution, provided funds are available. 1979 Op St Compt. File No. 905. The complete attorney response is on file at the Town Clerk office.

RESOLUTION No. 51
TOWN OF CANAAN APPOINTING JUSTICE PAMELA MELVILLE TO FILL RETIRING JUSTICE STELLING’S REMAINING TERM
WHEREAS, the Town Board of the Town of Canaan has accepted the resignation of Judge Peter Stelling, and
WHEREAS, the Town Board has received a letter of intent from acting Justice Pamela Melville to take on the work of the now vacant position, with the applicable compensation of pay, from August 27th, to December 31, 2007,
NOW THEREFORE, BE IT RESOLVED that the Town Board of the Town of Canaan appoints Justice Pamela Melville to serve for the remaining term of Justice Peter Stelling, with pay.
MOTION: Councilperson David Patzwahl made a motion, seconded by Councilperson Virginia Nightingale, to approve resolution #51. Roll call showed: Supervisor Gary Flaherty-yes, Councilperson Virginia Nightingale-yes, Councilperson Carrie Bither-yes, and Councilperson David Patzwahl-yes. Resolution #51 approved.

Supervisor Gary Flaherty introduced Mr. Garth Slocum. Mr. Slocum is a certified assessor and a practicing attorney and counselor at law. The board asked questions concerning Mr. Slocum’s work schedule and his ability to work with the public. No decisions were made. The Board thanked Mr. Slocum for his time and will be in touch with him as soon as the other applicant is interviewed.

Adjournment: Councilperson Carrie Bither made a motion, seconded by Councilperson Virginia Nightingale to adjourn the meeting at 8:21 p.m. 4-ayes, Motion Carried.
