Minutes of meeting held October 5, 2007
SPECIAL TOWN BOARD MEETING – OCTOBER 5TH, 2007
Supervisor Gary Flaherty opened the meeting at 6:00 p.m. with the Pledge of Allegiance to the Flag followed by a moment of silence.
There were five board members present: Supervisor Gary Flaherty present Councilperson Virginia Nightingale present Councilperson David Patzwahl present Councilperson Carrie Bither present Councilperson Stephen August present There were nine people in the audience.
Supervisor Flaherty read the Public Notice:
Supervisor Flaherty read a letter received from Mr. Sylvester Walker offering his home at the full market price of $212,805.00 to the town so the town could have the first option. The board decided to have an engineer inspection and a perk test done before making a decision.
Supervisor Gary Flaherty read the Department of Labor cost of living appropriation –(COLA) estimate for the coming year and said he increased salaries at 2.5%. Supervisor Flaherty then read his proposed budget for the fiscal year of 2008.
Councilperson Virginia Nightingale asked that the salaries be increased by 3%. The increase would only be about a $1,600 budget increase. Councilperson Stephen August said the due to fuel increases, food cost, and other living increases the 2.5% increase is marginal to cover costs of living.
MOTION: Hearing was closed at 8:20 p.m. by a motion made by Councilperson Carrie Bither, seconded by Councilperson Virginia Nightingale. Supervisor Gary Flaherty asked for a ten minute break.
MONTHLY MEETING – OCTOBER 5TH, 2007 Supervisor Gary Flaherty opened the monthly meeting at 8:35 p.m.
MOTION: MINUTES OF SEPTEMBER 10TH, 2007 were amended by Councilperson Stephen August to add on page 3, Energy Answers paragraph, “that the contract be addressed by the Town attorney for review.” Motion made by Councilperson Virginia Nightingale, seconded by Councilperson David Patzwahl, to accept the amended minutes. 5-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Virginia Nightingale-yes; Councilperson David Patzwahl-yes; Councilperson Carrie Bither-yes; and Councilperson Stephen August-yes. Motion Carried.
MOTION: Supervisor Flaherty asked if the board had reviewed the Supervisor’s monthly report. Motion made by Councilperson Virginia Nightingale, seconded by Councilperson Carrie Bither, to approve the monthly report. Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Virginia Nightingale-yes; Councilperson David Patzwahl-yes; Councilperson Carrie Bither-yes; and Councilperson Stephen August-yes. Motion Carried.
BILLS: Councilperson Carrie Bither made a motion, seconded by Councilperson Virginia Nightingale, to approve the presented bills. The General Fund, #240 thru #266 in the amount of $35,520.79. The Highway Fund, #107 thru #116 in the amount of $10,936.61. 5-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Virginia Nightingale-yes; Councilperson David Patzwahl-yes; Councilperson Carrie Bither-yes; and Councilperson Stephen August-yes. Motion Carried.
BOARD OF ETHICS: Mr. Al Vinck, a member of the Town Board of Ethics committee represented the ethics board. The committee had given the Town Board copies of their proposed Cover Letter and Financial Disclosure Statement. MOTION; Supervisor Gary Flaherty made a motion, seconded by Councilperson Virginia Nightingale to accept the proposed Cover Letter and the Financial Disclosure Statement presented by the Town Board of Ethics committee. 5-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Virginia Nightingale-yes; Councilperson David Patzwahl-yes; Councilperson Carrie Bither-yes; and Councilperson Stephen August-yes. Motion Carried.
Supervisor Gary Flaherty “Thanked” the Ethics Board for all their work.
HIGHWAY MONTHLY REPORT: Superintendent of Highways, Bernhard Meyer, read his monthly report. This report is on file at the Town Clerk office and may be seen during normal office hours. Superintendent Meyers said that work on the Flints Crossing Road would be done on October 14th, at 7:00 a.m.
MOTION: NEW MEDIUM DUTY TRUCK - Councilperson David Patzwahl made a motion, seconded by Councilperson Virginia Nightingale, to approve the bid for the medium duty truck from HLGauge in Albany at $61,151.82, only the cab and chasse that was presented by Superintendent Meyer.
MOTION: HIGHWAY FURNACE - Councilperson Virginia Nightingale made a motion, seconded by Councilperson Carrie Bither for Superintendent Bernhard Meyer to get RFP’s for a new furnace at the Highway garage. 5-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Virginia Nightingale-yes; Councilperson David Patzwahl-yes; Councilperson Carrie Bither-yes; and Councilperson Stephen August-yes. Motion Carried.
MOTION: WEB-HOST - Councilperson Virginia Nightingale made a motion, seconded by Councilperson David Patzwahl, to accept the Web Host contract for $155.40 per year from Technology 4 All, Inc. for 2008. 5-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Virginia Nightingale-yes; Councilperson David Patzwahl-yes; Councilperson Carrie Bither-yes; and Councilperson Stephen August-yes. Motion Carried.
MOTION: ANNUAL WEBSITE MAINTENANCE – Councilperson Virginia Nightingale made a motion, seconded by Councilperson Carrie Bither, to accept the annual website maintenance contract from Technology 4 All, Inc. for the year 2008. 5-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Virginia Nightingale-yes; Councilperson David Patzwahl-yes; Councilperson Carrie Bither-yes; and Councilperson Stephen August-yes. Motion Carried.
MOTION: AMBULANCE CONTRACT - Councilperson Carrie Bither made a motion, seconded by Councilperson Virginia Nightingale, to approve the District #1, Lebanon Valley Ambulance Service contract. 5-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Virginia Nightingale-yes; Councilperson David Patzwahl-yes; Councilperson Carrie Bither-yes; and Councilperson Stephen August-yes. Motion Carried.
MOTION: ACCOUNTANT CONTRACT – Councilperson Carrie Bither made a motion, seconded by Councilperson David Patzwahl, to accept Nelson E. Furlano’s bookkeeping services at $8,616.00 for the year 2008, payable monthly at $718,.00. 5-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Virginia Nightingale-yes; Councilperson David Patzwahl-yes; Councilperson Carrie Bither-yes; and Councilperson Stephen August-yes. Motion Carried.
MOTION: rewrite Local Law #1 of the year 2006 – Councilperson Virginia Nightingale made a motion, seconded by Councilperson Carrie Bither, to rewrite Local Law #2 of the year 2006, concerning training sessions. 5-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Virginia Nightingale-yes; Councilperson David Patzwahl-yes; Councilperson Carrie Bither-yes; and Councilperson Stephen August-yes. Motion Carried.
Councilperson Virginia Nightingale asked about the information received from the town attorney about Recreation Committee Establishment and if there was nothing more received. Supervisor Flaherty said that was all he received.
Supervisor Flaherty said that the Tieger case would be in court on October 20th, 2007.
ZONING LAWS: Councilperson Carrie Bither said that the latest revision has been found and would like the project to move forward.
RESOLUTION #54 – IN MEMORY OF DONALD F. MALIN, JR. WHEREAS, Almighty God, in His Infinite Wisdom, has seen fit to remove his servant Donald F. Malin, Jr. from his earthly toil and, WHEREAS, Donald F. Malin, Jr. served the Town of Canaan as a Planning Board member and as Planning Board Chairperson from August 1998 till August 2007; NOW THEREFORE, BE IT RESOLVED, that the Town Board and the Canaan Planning Board takes official notice of Donald F. Malin’s many contributions to the Town of Canaan, including his authorship of the cell-tower law, and BE IT FURTHER RESOLVED, that a certified copy of this resolution be transmitted to the family of the late Donald F. Malin. MOTION: Supervisor Gary Flaherty made a motion, seconded by Councilperson Virginia Nightingale, to approved said moton. 5-ayes, Motion Carried.
