Special Town Board Meeting – November 8th, 2007

Public Hearing
Supervisor Gary Flaherty opened the meeting at 6:05 p.m. with the Pledge of Allegiance to the Flag followed by a moment of silence. Supervisor Flaherty asked that we remember Mr. Ken Soule who recently passed away.

There were twelve people in the audience.

Supervisor Gary Flaherty read the Public Notice.
Supervisor Flaherty presented the Local Law #3 of 2007 for board questions and opened for public questions. Supervisor Flaherty said that the changes were to rescind Local Law #2 of 1995.
Public concerns: Mrs. Ann Pearce questioned some training sessions.
Mrs. Tammy Flaherty said that the Planning Board was trying to schedule DEC (Department of Environment Conservation) to present a training session in December.

Public Hearing on the Preliminary Budget for 2008.
Public concerns: Mr. Richard Keaveney asked about the Salt Shed budget.
Councilperson Virginia Nightingale asked about the Red Rock Fire contract. Supervisor Flaherty said that the contract can not be opened until next year when it is up for renewal.

All persons having been heard for or against the preliminary budget were heard.

Supervisor Flaherty closed the hearings at 6:15 p.m.

MONTHLY MEETING
Supervisor Gary Flaherty opened the monthly meeting at 6:17 p.m.

MOTION: MINUTES: Councilperson David Patzwahl made a motion, seconded by Councilperson Carrie Bither, to approve the October 5th, and the October 23rd, 2007 minutes. 4-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-yes. Motion Carried.

MOTION: Councilperson David Patzwahl made a motion, seconded by Councilperson Virginia Nightingale, to move $100,000.00 into the salt shed fund. 4-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-yes. Motion Carried.

MOTION: Councilperson Virginia Nightingale made a motion, seconded by Councilperson Carrie Bither, to move $70,000.00 to the Capital Fund. . 4-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-yes. Motion Carried.

CORRESPONDENCE: supervisor Gary Flaherty read the monthly correspondence. All correspondence is on file at the Town Clerk office and may be seen during normal office hours.

HIGHWAY REPORT: Superintendent of Highways, Bernhard Meyer, read his monthly report. The monthly report is on file at the town clerk office and may be seen during normal office hours. The Highway Department is now working their winter hours, 7:00 a.m. to 3:30 p.m, Monday thru Friday.

MOTION: Councilperson David Patzwahl made a motion, seconded by Councilperson Virginia Nightingale for the newly elected judges to attend the necessary school for certification with their meals, lodging, and mileage being reimbursed. 4-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-yes. Motion Carried.

RESOLUTION #55 – ADOPTING LOCAL LAW NO. 3 OF THE YEAR 2007, ENACTING ATTENDANCE AND TRAINING REQUIREMENTS FOR ZONING BOARD OF APPEALS AND PLANNING BOARD MEMBERS AND RESCINDING LOCAL LAW 2 OF 1995.
MOTION: Supervisor Gary Flaherty made a motion, seconded by Councilperson Carrie Bither , to adopt said resolution. 4-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-yes. Resolution adopted.

RESOLUTION #56 – APPOINTING RONALD DAVIS PLANNING BOARD CHAIRPERSON.
MOTION: Councilperson Virginia Nightingale made a motion, seconded by Councilperson Carrie Bither, to adopt said resolution. 4-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-yes. Resolution adopted.

RESOLUTION #57 – ADOPTING THE FISCAL BUDGET FOR THE YEAR 2008.
MOTION: Councilperson Virginia Nightingale made a motion, seconded by Councilperson Carrie Bither, to adopt said resolution. 4-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-no; Councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-yes. Resolution adopted.

MOTION: COLUMBIA COUNTY HUMANE SOCIETY CONTRACT
Councilperson Carrie Bither made a motion, seconded by Councilperson Virginia Nightingale, to agree to the annual contract and that the Supervisor shall sign said contract. 4-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-yes. Motion Carried.

MOTION: FUND APPRAISALS
Councilperson Virginia Nightingale made a motion, seconded by Councilperson Carrie Bither, to pay $500.00 for residential and $3,000.00 for commercial appraisals requested by the Town attorney for two tax certiorari proceedings, scheduled for early December. 4-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-yes. Motion Carried.

SLC CORPORATION – Tieger litigation. Supervisor Flaherty read Judge Donohue’s decision of October 31, 2007.
MOTION: Councilperson David Patzwahl made a motion, seconded by Councilperson Carrie Bither, authorizing the Supervisor to proceed according to the court order if not complied with by December 1st, 2007. 3-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-abstained. Motion Approved.

MOTION: TOWN HALL USAGE FORM - Town Clerk, Charlotte Cowan, presented the board with a “permission form”, created for all who wish to use the Town Hall on weekends to sign. Supervisor Gary Flaherty made a motion, seconded by Councilperson Carrie Bither, to approve the presented form with the amended addition of a signature line. 4-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-yes. Motion Approved.

AUDIENCE: Mrs. Ann Pearce asked that anyone with information concerning the mischievous behavior to her husband’s truck during the November election to please contact them.

Mrs. Sallee Dunton asked if the back door of the Town Hall could be painted and that the Highway Garage site be made more presentable.

MOTION: PUBLIC HEARING ON LOCAL LAW for CODE PUBLISHING
Councilperson Virginia Nightingale made a motion, seconded by Supervisor Gary Flaherty, to hold a Public Hearing on December 10th, 2007, at 7:00 p.m., prior to the Town Board meeting. 4-ayes, Motion Carried. Roll call showed: Supervisor Gary Flaherty-yes; Councilperson Carrie Bither-yes; Councilperson David Patzwahl-yes; Councilperson Virginia Nightingale-yes. Motion Approved.

ADJOURNMENT
Councilperson Virginia Nightingale made a motion, seconded by Councilperson Carrie Bither, to adjourn the meeting at 8:20 p.m. 4-ayes, Motion Carried.

MOTION: Supervisor Gary Flaherty made a motion, seconded by Councilperson Carrie Bither, to reopen the meeting at 8:22 p.m. 4-ayes, Motion Carried.

General Fund Bills: #267- #306 in the amount of $21,052.85.
