REGULAR MEETING, TOWN OF CANAAN, MARCH 10, 2008

A regular meeting of the Town Board of the Town of Canaan, county of Columbia, and the State of New York was held at the Town Hall, 1647 County Route 5, Canaan, NY on the 10th day of March 2008.

AUDIENCE: Twenty-six people.

Supervisor Keaveney opened the meeting at 7:00 p.m. with the Pledge of Allegiance to the Flag, followed by a moment of silence.

APPROVAL OF MINUTES: February 11th and February 28th, 2008: A motion made by Councilperson Brenda Adams, seconded by Councilperson Carrie Bither, to approve the minutes of February 11th 2008 and February 28th, 2008. Roll call showed:
ADOPTED: Ayes: 5 Keaveney, Adams, Stelling, Bither, Patzwahl
Nays: 0
BILLS: Councilperson David Patzwahl made a motion, seconded by Councilperson Peter Stelling, to approve payment of all bills presented as amended. General Fund: #50-#87, in the amount of $43,812.90; Highway Fund: #17-#32, in the amount of $38,990.79. Roll call showed:

MOTION: Public Hearing for Local Law No. 1 of 2008: Councilperson Brenda Adams made a motion, seconded by Councilperson Peter Stelling, to proceed with a Public Hearing for Local Law No. 1 of the year 2008, to amend Local Law 1 of 1996, to change the Assessment Review Hearings to the forth Tuesday of May and the following Saturday as an additional assessment grievance day. Roll call showed:

MOTION: Transfer of Funds: Councilperson David Patzwahl made a motion, seconded by Councilperson Carrie Bither, to transfer $2,600 from the General Fund account (A1910.4) to the new building maintenance account (A1620.11) as approved in resolution #36 of 2008. Roll call showed:

RESOLUTION #40: “All Around the Yard Landscaping” to maintain Flat Brook Cemetery Grounds for the summer 2008.
Councilperson Peter Stelling made a motion, seconded by Councilperson David Patzwahl, to approve said resolution. Roll call showed:

RESOLUTION #41: DISTRIBUTION of the CODEBOOKS of the Town of Canaan (General Code)
Councilperson Carrie Bither made a motion, seconded by Councilperson Brenda Adams to approve said resolution. Roll call showed:

RESOLUTION #42: APPOINTING ANDREW HOWARD ATTORNEY FOR THE TOWN OF CANAAN
Councilperson Peter Stelling made a motion, seconded by Councilperson Brenda Adams to approve said resolution: Roll call showed:

HIGHWAY REPORT: Superintendent of Highways, Bernhard Meyer, read his monthly report. It is on file at the Town Clerk office and may be seen during normal office hours. Superintendent Meyer read the results of the bids with his recommendations. (see attached results).
MOTION: Bids approved: Supervisor Richard Keaveney made a motion, seconded by Councilperson David Patzwahl, to approve all bids recommended by Superintendent of Highways Meyer. 5-ayes, Roll call showed:

Nays: 0

HIGHWAY GARAGE FACILITY DRY WELL CLOSURE: Superintendent Meyer informed the board that a proposal for Environmental Engineering Services has been received from Barton & Loguidice, P.C. This proposal is to remove the drywell in the garage that is used as a floor drain for motor vehicle waste disposal. The proposal is on file at the clerk’s office and may be seen during normal office hours.

MOTION: BID ON SANDER: Councilperson Brenda Adams made a motion, seconded by Councilperson Carrie Bither, for the Highway to go out for bid for a 10’ Stainless Steel Sander, estimated $15,000.00. Roll call showed:
ADOPTED: Ayes: 5 Keaveney, Adams, Bither, Stelling, Patzwahl
Nays: 0

TOWN WEB SITE: Supervisor Richard Keaveney said he has reviewed the Town web site and made the recommended changes to give to Technology 4 All to be done.

ASSESSOR: Town assessor, Jean Rohde was present. Councilperson Brenda Adams proposed that she be compensated for the clerical work she is doing.

ZONING LAW REVISIONS: Councilperson Brenda Adams “Thanked” the Planning Board and the Zoning Board for the many hours of work committed to revise the Town Zoning Laws. The board has been given a copy with the revisions.

AUDIENCE:
Mrs. Ann Pearce asked about applications for the Assessment Review Board. Supervisor Keaveney said that we have only received four applicants and would encourage others to apply, we would like to have five BAR members. A decision will be made at the April meeting.

Ms. Cim Smith asked if the Transfer Station could be cleaned. Supervisor Keaveney said that they are in the process of repairing and cleaning the area.

Highway Superintendent, Bernhard Meyer said that nineteen roads were affected by wash outs with the last rainstorm, most have been restored.
